Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services provided by Latency Labs LLC ("Latency", "we", "us", or "our").

1. Acceptance

By accessing or using Latency, you agree to be bound by these Terms. If you do not agree, do not use the service.

2. Use of the service

You may use Latency only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the service to monitor systems you do not own or have authorization to monitor
• Attempt to probe, scan, or test the vulnerability of any Latency system
• Circumvent any rate limits or access controls
• Resell or sublicense access to the service without prior written consent

3. Accounts

You are responsible for maintaining the security of your account credentials. Notify us immediately at feedback@latency.app if you suspect unauthorized access.

4. Data & privacy

Your data is processed in accordance with our Privacy Policy. We do not sell your data to third parties.

5. Service level

Latency targets 99.9% platform uptime. Scheduled maintenance will be communicated at least 24 hours in advance. We are not liable for downtime caused by third-party infrastructure providers.

6. Payment

Paid plans are billed monthly or annually in advance. All fees are non-refundable except where required by law. We reserve the right to suspend accounts with overdue invoices.

7. Termination

Either party may terminate the agreement at any time. Upon termination, your data will be retained for 30 days before permanent deletion.

8. Limitation of liability

To the maximum extent permitted by law, Latency Labs LLC shall not be liable for any indirect, incidental, special, or consequential damages.

9. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions.
